Probate

Probate is the legal process of administering a deceased’s estate when a person dies having made a valid Will.  If someone dies without a will the deceased has died intestate and instead of obtaining probate Letters of Administration must be applied for.

Probate 

We assist the Executors named in a Will with their legal duty to:

  • value all the deceased’s assets and identify their debts

  • apply, if necessary, for the Grant of Probate, which then gives the Executors authority to act

  • consider any claims against the deceased’s estate

  • settle the deceased’s income tax affairs

  • calculate and arrange the payment of any tax, debts and specific gifts in the will

  • distribute the Residuary Estate to those entitled under the will

  • establish guardians where children are involved

 

Administration 

In such circumstances, we can assist you with the following:

  • value all the deceased’s assets and identify their debts

  • identifying who may be entitled to benefit from the deceased’s estate and the order of entitlement

  • apply, if necessary, for the Letters of Administration, which then gives those persons so entitled to benefit from the deceased’s estate with authority to act

  • consider any claims against the deceased’s estate

  • settle the deceased’s income tax affairs

  • pay any tax, debts due from the estate.
